Acceptable Use Policy

This policy sets the boundaries for using Prop Elite. Most of it comes down to three things: hold the licences your work requires, treat other people's personal data lawfully, and do not attack or abuse the platform.

1. Scope

This policy forms part of our Terms of Service and applies to everyone who uses Prop Elite or aetherailabs.net, including every user your agency invites. You are responsible for your users' compliance with it.

2. General rules

You must not use the service to:

  • Break any law that applies to you, or help someone else break it.
  • Infringe anyone's intellectual property, privacy or contractual rights.
  • Store or transmit malware, or content that is defamatory, harassing, obscene or intended to deceive.
  • Impersonate another person, agency or organisation, or misrepresent your affiliation with one.
  • Resell, sublicense or otherwise make the service available to a third party as if it were your own product, unless we have agreed in writing.

3. Real-estate practice and commission

Prop Elite records property transactions and calculates commission. That places obligations on you that no software can discharge on your behalf:

  • You and your agents must hold the registrations and licences your work requires under Malaysian law, including registration with the Board of Valuers, Appraisers, Estate Agents and Property Managers where it applies.
  • Listings you publish or circulate must be accurate, and you must have the owner's authority to market the property.
  • Commission structures you configure must be tied to genuine completed property transactions. You must not use the downline or override features to operate a recruitment-driven or pyramid scheme, which is prohibited under the Anti-Pyramid Scheme Act 1993.
  • You are responsible for the tax treatment of the commissions and payouts you record, and for verifying calculated figures before you pay or file on them.

4. Personal data and communications

  • Only upload personal data about clients and leads where you have consent or another lawful basis under the Personal Data Protection Act 2010.
  • Do not upload lists of contacts obtained by scraping, purchase from an unlawful source, or any means the individuals did not agree to.
  • Do not use the service to send unsolicited bulk messages, and honour opt-out requests from the people you contact.
  • Give your users only the access their role needs, and remove access promptly when someone leaves your agency.

5. Platform security and integrity

You must not:

  • Attempt to access another agency's workspace, account or data.
  • Probe, scan or test the vulnerability of the service, or defeat authentication or rate limits, without our prior written consent.
  • Reverse engineer, decompile or attempt to derive the source code of the service, except to the extent the law expressly permits.
  • Use automated means to extract data at a scale or rate that degrades the service for others.
  • Interfere with the service, its infrastructure, or any other user's use of it.

If you find a security vulnerability, tell us at [email protected] before disclosing it anywhere else. We will not pursue action against good-faith research that is reported promptly and does not access other users' data.

6. Fair use

Plans are sold per seat for normal business use. Seats are for named individuals — sharing one login between several people is not permitted. If your usage places a disproportionate load on shared infrastructure, we will contact you to agree a workable arrangement before taking any restrictive step.

7. How we enforce this policy

Where we believe this policy has been breached, our response is proportionate to what happened:

  • For most issues we contact you first and give you a reasonable period to put it right.
  • We may remove or restrict access to specific content or features.
  • For serious or repeated breaches, or where there is a risk to other users, to personal data or to the platform, we may suspend or terminate access immediately.
  • We may report conduct to the relevant authority where the law requires it.

Suspension or termination for breach of this policy does not entitle you to a refund. See the Refund and Cancellation Policy.

8. Reporting a problem

To report abuse, a security issue, or content that breaches this policy, email [email protected] with the details and, where possible, the workspace or listing concerned. We acknowledge reports and investigate them.
